General terms and conditions of business

1. Scope
These General Terms and Conditions apply to all guest accommodation contracts concluded between the hotel "Am Kurpark" owner B. Schmunck-Botterhuis and third parties (guests) and to all other services and deliveries provided by the hotel "Am Kurpark".
 
2. Reservations/Resale
By accepting a reservation made by the guest, an accommodation contract has come about. This agreement, in the form of a reservation of ordered rooms, is binding for both contracting parties. The reservation for ordered but not yet paid rooms is valid until 6 p.m. on the day of arrival. There is no entitlement to use the overnight service in a specific room. The hotel reserves the right to rent the reserved rooms to someone else after the reservation has expired. The guest receives a binding booking or reservation number from the hotel and, if expressly requested, also a written reservation confirmation. The resale/renting and/or the brokering of booked rooms is prohibited. In particular, the forwarding of rooms and/or room contingents to third parties at higher prices than the actual room prices is not permitted. The assignment or sale of the claim against the hotel is also not permitted. In these cases, the hotel is entitled to cancel the booking, especially if the guest has given false information to the third party about the type of booking or the payment during the assignment/sale. Use of the hotel room for any purpose other than accommodation is expressly prohibited.
 
3. Guaranteed reservations, cancellation deadlines
A guaranteed reservation is given if the guest confirms the overnight service by means of a credit card number or sends the signed reservation confirmation to the hotel within 3 working days and does not cancel the reserved room by the 7th day before departure. The cancellation fees are 90% of the travel price from the 7th day before the start of the trip or non-arrival (no show). For bookings within the framework of a contingent contract or for a reservation of more than five rooms per night, the cancellation periods and other agreements agreed in these contracts apply.
 
4. Advance payment of the accommodation price
The price of the entire booked accommodation service must always be paid in advance by the guest, at the latest upon arrival at the hotel.
 
5. Taxes/Fees/Duties
The applicable prices are total gross prices and include all statutory taxes, fees and charges. The hotel reserves the right to adjust the prices accordingly in the event of a change in the rates of taxes, fees and charges, as well as the effective levying of new taxes, fees and charges previously unknown to the parties.
 
6. Means of payment
Valid means of payment are cash in euros and EC cards.
 
7. Possibilities of using reserved rooms
Reserved rooms are available to the guest from 2 p.m. on the day of arrival and until 11 a.m. on the day of departure.
 
8. Liability
If the guest is provided with a parking space in the hotel garage/parking lot, even for a fee, this does not result in a safekeeping contract. There is no monitoring obligation on the part of the hotel. The guest is obliged to report any damage immediately, obvious damage, at least before leaving the parking facility. The hotel is not liable for damage for which other tenants or other third parties are solely responsible.
 
9. Vouchers
The voucher can only be redeemed for hotel services. If there are remaining credit balances when making payments with the voucher, they remain in place and can be used for further payments in the . The voucher is valid for 3 years from the date of issue. Vouchers are non-returnable, non-resalable, non-transferable and non-redeemable for cash. The vouchers cannot be used for online payments. The person ordering the voucher is responsible for providing the correct data (in particular the e-mail address) to which the voucher and the invoice should be sent.
Cancellation policy: Declarations on vouchers can be revoked within 14 days without giving reasons in any form (letter, fax, e-mail) or, if the voucher is provided before the deadline, also by returning the voucher. The period begins after receipt of this instruction in text form, but not before receipt of the voucher by the recipient. To meet the cancellation deadline, it is sufficient to send the cancellation or the voucher in good time. 10. Food and drinks brought in The consumption of food and drinks brought in is prohibited in the public areas. Breakfast can only be taken in the designated areas of the public area (bar, lounge). It is not possible to take breakfast items that are offered with you. The preparation of food in the rooms is prohibited.
 
11. No smoking in the hotel
We are a non-smoking hotel. It is therefore forbidden to smoke both in the public areas and in the guest rooms. In the event of an infringement, the hotel has the right to demand an amount of EUR 200.00 from the guest as compensation for the cleaning costs to be paid separately, including any loss of revenue from the room being unable to be rented as a result. This amount of damages is to be set higher or lower if the hotel proves a higher damage or the guest proves a lower damage.
 
12. Pets
Bringing a pet requires the consent of the hotel. The guest is obliged to announce the wish to bring a pet in advance. If the hotel agrees to pets being brought along, this is subject to the condition that the pet is under the guest's constant supervision, is free of illnesses and otherwise poses no danger to the hotel guests and hotel staff. Taking the animal with you to breakfast and the restaurant is not permitted. There is a fee of EUR 10.00 per night for the pet. However, guide dogs, deaf dogs and other comparable service dogs are exceptions. These may be carried free of charge and at any time.
 
13. Group Bookings
For bookings of 5 rooms or more, only guaranteed reservations can be made with appropriate prepayment. In addition, the separate contractual provisions apply here.
 
14. Final Provisions
Changes and additions to the contract or the general terms and conditions should be made in text form. Unilateral changes or additions by the guest are ineffective. The place of jurisdiction for all disputes arising between the parties from the contractual relationship is Quedlinburg, insofar as the contractual partner is the hotel.
